The Fulton County Sheriff's Office charged Jerry Lee Huber, 54, of Viola with aggravated assault Oct. 24 after he allegedly shot Zachery West, 21, also of Viola, Oct. 14.
According to Fulton County Deputy Jason Martin, Huber confronted West and his brother Kaleb on Tuscan Lane in Viola after the brothers rear-ended his son Derek Huber's vehicle and verbally assaulted him.
The elder Huber fired some warning shots in front of the West boys, but the shot that wounded West was unintentionally discharged after one of the brothers assaulted the elder Huber, according to Martin.
The circumstances that prompted the West brothers to initiate an argument are unclear; however, Derek Huber and one of the West brothers do have a mutual ex-girlfriend, said Martin.
Martin said he wanted to ensure that the details surrounding the case were known because the story published in The News Oct. 19 read as though West was innocent in the matter.
West was taken to Baxter County Regional Medical Center in Mountain Home where he was treated and released Oct. 15 for a gunshot wound just above his knee.
There are currently aggravated assault and disorderly conduct charges pending against Zachery and Kaleb West for their involvement in the incident.
There are no charges against Derek Huber.
Jerry Huber would not comment regarding the case.
West could not be reached for comment.
