A Salem man charged with multiple sexual assault counts in April 2003 had two of those charges upgraded to rape June 15 by 16th Judicial District Deputy Prosecutor Dwayne Plumlee.
Arkansas State Police Investigator Becky Vacco said Theo M. Morris, 27, was originally charged with three counts of sexual assault in the second degree. She said the case was reviewed and Plumlee decided to revise the charges.
Morris has been charged with two counts of rape, class Y felonies; and one count of sexual assault in the second degree, a class B felony.
According to an affidavit released by the Fulton County Clerks Office, Morris assaulted three women on separate occasions.
A 16-year-old female told Vacco that Morris sexually assaulted her in July of 2002, at his residence. The alleged victim, a friend of Morris' wife, Brandi, said she became intoxicated and fell asleep in the Morrises' spare bedroom.
When she awoke, she said, Morris was in bed with her and had in his hands in her undergarments, committing a sexual act. The accuser pushed Morris away and pretended to fall asleep. Morris again put his hands on her and she left the room.
She said Morris apologized the next day.
A 22-year-old female said Morris sexually assaulted her on Feb. 22, 2003, at her residence.
The alleged victim said she went to the Moose Lodge in Salem with her boyfriend, Morris and his wife. The accuser said she became intoxicated and had a friend take her home. The Morrises and her boyfriend stayed at the Moose Lodge.
The accuser said when she awoke a person entered her room and touched her. The person kissed her, exposed her breasts and put his hand in her underwear. She said she thought it was her boyfriend. She said she realized it was Morris when a voice said, "Theo, let's go."
The alleged victim and her boyfriend said they confronted Morris the next day and he said he was sorry and it wouldn't happen again.
An 18-year-old female said Morris attacked her at his residence March 8, 2003, after she became intoxicated at Morris' birthday party. She said she fell asleep in the Morrises' bed because another guest was asleep in the couple's spare bed.
The accuser said Morris came into the room and started touching her underneath her underwear and kissing her. Brandi Morris entered the room and asked Morris what he was doing. Morris said he was going to sleep and Brandi left, according to the alleged victim.
The alleged victim got out of bed and passed out on the bathroom floor she said and Morris picked her up and put her on the couch.
Morris' is free on a $10,000 bond. He will be arraigned in Fulton County Circuit Court July 1.
