Pacheco granted change of venue

ALTON -- A change of venue has been granted in the trial involving the man that has been accused of setting a fire in the Oregon County Jail causing the death of another man.

Nicholas Pacheco, 19, is charged with first-degree arson and second degree murder in connection with a fire at the Oregon County Jail at Alton that occurred Sept. 6, 2007. Jesse Johnson, 17, of Mammoth Spring was an inmate in the jail at the time of the fire and died of smoke inhalation.

The change of venue was granted Dec. 1 by 36th Judicial Judge Mark Richardson of Poplar Bluff. Judge Richardson has presided over other court preceedings involving Pacheco. The case has been moved to Butler County. He is now in jail in Poplar Bluff. He will be defended by public defender Ian Hauptli.

Oregon County Prosecutor Fred O'Neill charges that Pacheco burned papers and other articles in his jail cell causing smoke. The other prisoners jailed in the other cells in the jail could not escape.

A trial date has not been set.
