Ash Flat Alderman charged with DWI

An Ash Flat Alderman has been charged with DWI after being reported to a Hardy police officer for careless driving and nearly causing three accidents.

According to an incident report from the Hardy Police Department, Jerrell R. Lesley was charged with DWI after the silver SUV he was driving was noticed by another motorist driving in a hazardous fashion.

The report indicates that Officer David Henry of the Hardy Police Department responded to a call from a female motorist. The caller informed the officer of the vehicle's whereabouts and the officer located the vehicle driven by Lesley.

Henry noted the vehicle crossed the fog line five times and the center line on four different occasions before turning onto Highway 62/412, where the officer attempted to stop Lesley in the parking lot of Rebel Time Out.

The report states Lesley did not pull over, but passed the car and ran onto a curb, striking a guard rail before stopping.

Lesley gave the officer consent to perform a field sobriety test and to take a portable breathalyser test. He blew a .41 and failed a horizontal gaze nystagmus test by six points before being placed under arrest for DWI.

Lesley was transported to the Sharp County Jail, where he took another breathalyser test with the results of .28.

The legal limit for the state of Arkansas is .08. Lesley was given a March 3 court date.
