According to an Affidavit for Probable Cause from the Prosecutor's office, Oren Gene Friesland, 61, of 708 East Main St. in Hardy was arrested for rape, after an incident that occurred in his home earlier in the month was reported to a counselor.
The report was turned over to the Department of Human Services, which referred the crime to a State Police Crimes Against Children investigator.
The female victim was staying in the home of Freisland when the incident occurred.
According to the affidavit, the sex act occurred in the bedroom of the Freisland home, while Friesland's wife was sleeping. The victim stated she kicked Friesland away.
Arkansas State Police Special Agent Wendall Jines interviewed Freisland July 27 at which time he admitted to laying on the bed near the victim while his wife was sleeping on the other side of the bed.
Freisland told the agent the victim tried to kiss him and instigated other sexually related acts.
Although Freisland admitted to taking part in a portion of the victim's account of the incident, he denied being kicked.
Freisland was arrested and charged with rape, a class Y felony, and, according to the affidavit, Freisland's fine and prison sentence could be doubled, due to his previous sex crime conviction.
Records indicate Freisland is currently on active probation and is also a registered child sex offender.
Freisland was arrested July 21. His bond was set at $100,000 cash, and he remains in the Sharp County Jail.
